Burn Ban in Effect

ARTICLE III. BURNING

State Law reference— Authority to adopt rules for prevention of fires, V.T.C.A., Local Government Code § 342.003(a)(13).

Sec. 16-46. - Mayoral authority.

The city council hereby authorizes the mayor of the city to establish and remove burn bans as the mayor determines the establishment and removal of a burn ban to be in the best interest of the citizens of the city. In making the decision to establish or remove a burn ban, the mayor may, but is not required to, consider the then-current drought and rainfall conditions, burn bans established or removed by the county, consultations with local fire officials and recent fires in or near the city.

Sec. 16-47. - Burning prohibited.

No person may cause, suffer, allow, or permit any outdoor burning within the city during a period in which a burn ban is established as set forth in section 16-46.
